How Does Buying Property in Mallorca Work?

1. Preparations
Which Area Should I Choose?

How Should I Finance My Property Purchase?
We always recommend exploring loan options in your home country, as they often offer better terms. This also allows you to act quickly when the right property appears. We also have banking partners in Spain who can assist with financing.

2. The Buying Process – Step by Step

What Is an Option Agreement?
Once you find the right property, we negotiate the best terms for you. Then, an option agreement is signed, and a deposit of around 10% is paid. Since properties are often listed with multiple agents, the option agreement ensures the property is reserved while legal and financial checks are completed.

The contract includes:
✔ Price and what is included in the purchase (e.g., furniture)
✔ A set closing date, usually 4–6 weeks after signing

If you decide not to proceed with the purchase, the deposit is forfeited. If the seller backs out, they must refund your deposit plus a penalty equal to the deposit amount.

Do I Need a Lawyer?
It's not required, but we highly recommend it. An experienced lawyer ensures all legal aspects are in order and helps with:
✅ Drafting the option agreement
✅ Handling the NIE application (Spanish tax ID)
✅ Ensuring there are no hidden debts or legal issues with the property
✅ Managing deposit and final payment transfers
✅ Attending the closing and interpreting the contract

How Does the Closing Process Work?
On the closing day, the buyer and seller meet at a Notary Public, where the deed is signed, final payment is made, and keys are handed over. A final inspection of the property is done the day before.

The notary registers the purchase in the property registry, and about three months later, you receive the deed listing you as the new owner.

3. Taxes and Fees – What Does Buying Property in Mallorca Cost?

In addition to the purchase price, expect to pay around 10–15% in taxes and fees.

✔ ITP (Transfer Tax): 8–13% on resale properties
✔ VAT (IVA): 10% on new-build properties
✔ Notary & Property Registration Fees: Around 1%
✔ Legal Fees: Around 1%

Annual Fees:
✔ Property Tax (IBI): 0.4–1.1% of the assessed value
✔ Waste Collection Fee: Around €200 per year
✔ Ongoing costs: Electricity, gas, water, internet, and community fees – expect around €300–400 per month for an apartment.

Wealth Tax:
